BIRMINGHAM, Ala. (AP) - Federal prosecutors say a Quinton man has been indicted by a grand jury for threatening an African-American man at a Walker County restaurant.

Officials said Thursday that 28-year-old Jeremy Heath Higgins is charged with one felony and two misdemeanor counts of interference with a federally protected activity.

Prosecutors in Birmingham say Higgins saw a black man with a white woman at the Alabama Rose Steakhouse and was asked to leave the business because of his behavior toward the man. Authorities say Higgins threatened the person who asked him to leave, and shouted a threat to burn the restaurant down. Officials say Higgins is also suspected of painting graffiti outside the restaurant and on its fence.

It’s unclear if Higgins has an attorney.
