NORFOLK, Va. (AP) - The Supreme Court of Virginia has agreed to hear a case involving the death of a Norfolk police recruit.

John Kohn collapsed during self-defense training at the Norfolk Police Department on Dec. 9, 2010, and later died. A state Labor Department investigation found the 40-year-old Kohn was repeatedly struck in the head.

Kohn’s widow, Patricia Kohn, sued a former police chief, a former acting police chief and several training officers in 2011.

Norfolk Circuit Court Judge Mary Jane Hall stopped the lawsuit in May 2013. Hall ruled that Virginia’s worker’s compensation law is the family’s remedy.

Patricia Kohn appealed Hall’s ruling to the Supreme Court. Her attorney, Steve Emmert, tells media outlets that he expects the court will hear the case in June or September.
