ALBUQUERQUE, N.M. (AP) - New Mexico State Police says a 40-year-old man shot and killed by state police did not fire at officers as previously reported.

State Police spokesman Damyan Brown told the Albuquerque Journal (https://goo.gl/ZkoXAG) on Monday that Ernest Attebery did not exchange gunfire during a standoff in the small community of Moriarty last week.

He says state police tactical team member Shane Todd shot Attebery after the hours-long SWAT situation. Officials say it was Todd’s second shooting in less than a year.

Brown says he couldn’t release any information on what the threat was because the shooting is under investigation.

The shooting comes as New Mexico State Police is under fire for least seven shooting by its officers since Chief Pete Kassetas took over in August.
