CONCORD, N.H. (AP) - Gov. Maggie Hassan is asking the New Hampshire Supreme Court to uphold a lower court decision that bars a new scholarship program from using money to help students attend religious schools.

Under the program, businesses get tax credits for donating to a private organization that awards scholarships to students attending either private or public schools. Last year, the lower court declared the program unconstitutional, but allowed it to continue as long as none of the money went to religious schools.

Hassan filed a brief with the court Monday supporting the lower court’s ruling. She said the program is misguided policy that undermines the public education system and violates the constitutional principle of separating church and state.

Supporters argued the money should not be considered public funds.
