DOVER, Del. (AP) - Attorney General Beau Biden’s office has withdrawn a subpoena seeking to force Facebook to reveal the identity of owner of a page that features postings highly critical of Wilmington government officials.
The subpoena was issued Dec. 11 seeking the name of the account holder for the “Peaceful Rioters of Wilmington” Facebook page. Biden’s office said last week that the subpoena involved an ongoing criminal investigation, but it refused to provide details.
The American Civil Liberties Union filed a motion to quash the subpoena, saying that revealing the identity of the Facebook account holder would violate the person’s constitutional rights, including the right to free speech.
In a response filed Friday, Biden’s office said it was withdrawing the subpoena, saying the information originally sought was no longer necessary.
