DOVER, Del. (AP) - The federal government has agreed to pay $307,000 to the parents of a boy who allegedly was the unknowing subject of an experiment involving the National Institute of Health.

A federal lawsuit filed in 2007 claimed that Kevin Dieffenbach underwent multiple surgeries related to complications involving a pacemaker that was surgically implanted in 1995 by an employee of the NIH.

The lawsuit claimed that Kevin’s parents were never told that pacemaker procedure was part of an experiment at the NIH and that there were safer alternatives available to treat his heart condition.

Dieffenbach died in 2010.

A stipulation of dismissal of the lawsuit was filed in federal court in Wilmington on Friday. The government did not admit any liability or wrongdoing.
