CASPER, Wyo. (AP) - Premeditation is again the focus at the trial of a Casper man accused of fatally shooting his wife during an argument last year.

Thomas Miller’s second trial opened Monday in Thermopolis. The Casper Star-Tribune (https://bit.ly/1liIDGU ) reports that his attorneys again didn’t dispute that he shot Natalie Miller on March 26 after a night of drinking but began to argue that the killing wasn’t premeditated.

Prosecutors must show Miller planned to kill his wife in order to win a first-degree murder conviction.

The case was moved to Thermopolis after the first trial ended in a mistrial after the victim’s mother, Debbie Boggs, spoke about an alleged affair by her son-in-law. The topic was previously deemed off-limits. She testified again Monday without incident.

The trial is expected to run through Friday.
