SPOKANE, Wash. (AP) - A judge in Spokane has declared a mistrial in the retrial of a man who was accused of pushing his pregnant girlfriend out of a moving car.

The Spokane County Superior Court jury said Wednesday it was deadlocked.

The Spokesman-Review reports (https://bit.ly/Meqfj9) a third trial for 30-year-old John Lipinski of Cheney is tentatively set for May.

He was found guilty in 2006 of second-degree murder and manslaughter in the 2004 deaths of Melissa Salvidar and their unborn daughter.

Lipinski won a new trial last year after an appeals ruling that lawyers should not have questioned some potential jurors in private.
