BOSTON (AP) — A Cape Cod town and other local opponents of the Cape Wind energy project are appealing a federal judge’s decision to dismiss their lawsuit.

The town of Barnstable, the Alliance to Protect Nantucket Sound and local businesses and residents argue in their appeal that the judge was wrong to rule that the federal court had no jurisdiction in their suit, which challenged the company’s contract to sell energy to NSTAR, a local utility provider. The appeal was filed Tuesday in Boston.

In their original lawsuit, opponents of the project alleged state regulators had coerced NSTAR into agreeing to buy power from Cape Wind at above-market rates that will lead to higher energy costs. Cape Wind proposes building more than 100 turbines in Nantucket Sound.
