DENVER (AP) - This week’s Bill To Watch in the Colorado Legislature
THE BILL:
Senate Concurrent Resolution 2, to refer a question to voters in November regarding search warrants for electronic records.
WHAT IT DOES:
This resolution seeks to put a question in the November ballot, asking whether law enforcement should get warrants to search electronic data, such as phone and email records, or data stored in a cloud. If approved, the requirement would be put in the state constitution.
WHO WANTS IT?
Democratic Senate President Morgan Carroll and Sen. Greg Brophy, R-Wray, are sponsoring the proposal. Rep. Dan Nordberg, R-Colorado Springs, is sponsoring the measure in the House.
HOW MUCH WILL IT COST?
If the question gets placed on the ballot, it will be part of the normal costs of conducting an election. Information about the proposed amendment would also be placed in the informational Blue Book that is sent to voters. The book with all the issues on the ballot costs about $1.3 million to produce.
WHERE IT STANDS:
The resolution won unanimous approval in the Senate Monday and now heads to the House. At least two-thirds of the full Senate and House need to approve it for it to be put on the November ballot.
WHAT THEY’RE SAYING:
“Your personal property, just because it’s electronic, doesn’t mean that you shouldn’t have the usual Fourth Amendment protections against unreasonable searches and seizures.” - Sen. Carroll.
