BUCKHANNON, W.Va. (AP) - A judge has dismissed a former Upshur County sheriff candidate’s lawsuit against the County Commission.

David Taylor’s lawsuit alleged that current and former commissioners conspired to violate his rights in the 2012 Republican primary election.

U.S. District Judge John Preston Bailey granted the County Commission’s motion to dismiss the case earlier this month. The commission argued that Taylor’s lawsuit failed to state a claim upon which the court could grant relief.

Taylor tells The Inter-Mountain (https://bit.ly/1jW7vl5 ) that he’s disappointed. But he respects the court’s decision. He says he won’t pursue the matter.

The County Commission says it’s pleased with the decision.

Taylor lost to Mike Kelley in the 2012 GOP primary. Kelley later withdrew from the race. Taylor alleged that he was denied due process after he contested the election.
