A Florida dentist is accusing President Obama of crossing a constitutional line by waiving the mandate in Obamacare for some employers and has taken his troubles to federal court.
“I feel that he crossed the red line when he chose to waive the employer mandate,” said Dr. Larry Kawa, a Florida dentist who told Newsmax he’s filed a lawsuit to halt that part of the law. “He generally rules by executive fiat, and he feels that he’s a Congress of one. … [The president can’t legally] pick and choose which parts of the law he’s going to enforce for the sake of political convenience.”
Judicial Watch filed the lawsuit on his behalf, naming the U.S. Treasury and the Internal Revenue Service as the defendants. The suit, filed in the Southern District of Florida, claims delaying the employer mandate “exceeded statutory authority, is arbitrary, capricious and contrary to law, and is otherwise unlawful,” Newsmax reported.
This is just the latest legal challenge against facets of Obamacare. Another case weaving through federal court accuses Obamacare of conflicting with the Constitution’s Origination Clause — the clause that calls for revenue-raising measures to come from the House, not the Senate or executive.
Other suits challenge the health care package’s mandate for health plans to pay for birth control, even is the private employer objects to such coverage.
