Usher’s ex-wife, Tameka Raymond, filed custody on Wednesday for the two children she had with the singer, after their 5-year-old son nearly drowned in a pool accident while in Usher’s care.

The boy, Usher V, was trapped in the bottom of the pool’s suctioned drain on Monday. He had been trying to retrieve a toy. An aunt, Rena Oden, was supervising his swim, The Daily Mail reported.

And on that note, Ms. Raymond alleges Usher actually created a “dangerous environment” by “abdicating” his parental responsibilities and allowing others to care for the two children, The Daily Mail said.

She’s seeking an emergency hearing for a judge in Fulton County, Ga., to grant immediate custody, TMZ reported. Usher currently maintains primary custody, while Ms. Raymond has limited rights. The two divorced in 2009, after having two sons together — the 5-year-old boy and 4-year-old Naviyd.

The boy is currently in care at an ICU in an Atlanta hospital. Doctors say his condition is “OK,” The Daily Mail reported. His arm was trapped in the drain vent in the pool at the singer’s home early Monday night, and Ms. Oden along with a maid jumped into the water to try and pull him free. The boy was finally pulled to safety, given CPR and taken to the hospital.

The 911 tapes of Ms. Oden’s frantic call were released Wednesday.
