Americans were outraged to hear the news that three murder charges against Dr. Kermit Gosnell were dismissed Tuesday, but Judge Jeffrey Minehart had a change of heart Wednesday, reinstating a charge against the doctor for the murder of “Baby C.”

The judge admitted he “erred” when dropping the charge for the baby, who was a victim of an attempted abortion and tossed in a shoe box while still alive. Gosnell staffers confirmed they saw the baby breathing for 20 minutes, LifeNews reports.

Gosnell faces eight total murder counts — one for killing a woman in a botched abortion and seven for killing babies in abortion-infanticides, LifeNews reports.

The judge also dropped five counts of corpse abuse Tuesday and did not explain his ruling.
