An appeal hearing is set for Monday for a Gaithersburg man detained for more than two months in Aruba in the disappearance and presumed death of his travel companion.

Aruban attorney Michael Lopez says the appeal hearing for his client Gary Giordano is scheduled for 10 a.m. Monday. Mr. Lopez is seeking the release of Mr. Giordano pending any future trial in the case.

Mr. Giordano, 50, has been held in custody on the Dutch Caribbean island since Aug. 5 for suspected involvement in the disappearance of 35-year-old Robyn Gardner, of Frederick, Md. The two traveled together to Aruba on July 31.

On Aug. 2, Mr. Giordano reported Ms. Gardner missing, claiming she was swept out to sea while the two were snorkeling. Although authorities brought in cadaver dogs to search for Ms. Gardner this month, her body has not been found.

A judge rejected a previous appeal in Mr. Giordano’s case, which sought to overturn a 60-day detention. The detention order will expire at the end of this month, at which point prosecutors are expected to either bring charges against Mr. Giordano or seek to extend the detention order.
