THE APPEAL: The Federal Communications Commission and the Justice Department are appealing a federal appeals court ruling that struck down a 2004 FCC policy that says broadcasters can be fined for allowing even a single curse word to be uttered on live television.
WHAT THE COURT FOUND: A three-judge panel of the 2nd U.S. Circuit Court of Appeals in New York threw out the FCC policy last month, saying it was unconstitutionally vague.
WHAT THE FCC SAYS: The agency warns that the ruling appears to invalidate its entire approach to regulating indecency over the airwaves.
