COLUMBIA, S.C. (AP) - The South Carolina Supreme Court says two residents of a coastal town and an environmental group can challenge a 2009 annexation.
The Post and Courier of Charleston reported the court ruled this week that two residents of Awendaw north of Mount Pleasant and the Coastal Conservation League may challenge the annexation that cut through the Francis Marion National Forest.
That annexation went through the federal land to reach a privately owned 360 acre (145 hectare) tract.
The newspaper reported the ruling could affect the town’s ability to expand into the national forest.
The justices’ decision allowing the challenge to continue does not determine whether the annexation itself was legal.
Neither Awendaw Mayor Miriam Green nor Town Administrator Bill Wallace would talk about the decision Thursday.
Awendaw incorporated in the 1990s.
