TRENTON, N.J. (AP) - New Jersey’s Supreme Court ruled in favor of lawmakers and a labor union in the state’s first test of constitutional authority granting the Legislature the power to review an administration’s regulations.
The court ruled Wednesday in a case dating back to Republican Gov. Chris Christie’s administration that the Democrat-led Legislature exercised its constitutional authority when it moved to block a regulation.
The case pitted Christie’s Civil Service Commission against legislative leaders, the Communications Workers of America and the AFL-CIO.
In 2013, the commission proposed regulations to allow some promotions without competitive examinations.
Lawmakers passed resolutions to block the under the 1992 Legislative Review Clause arguing that the rule was contrary to legislative intent.
Christie’s administration went forward with the rules and the lawsuit followed.
