CHARLESTON, S.C. (AP) - Felony charges against two former College of Charleston fraternity brothers jailed in connection with an alleged sexual assault at an on-campus party have been dismissed.

The Post and Courier reports the charge against 22-year-old James West III was dropped after a detective failed to show up in court last month. Prosecutors also decided to abandon a felony charge against 22-year-old Timothy Seppi.

Charleston police had asked prosecutors to indict West on the same count of third-degree criminal sexual conduct, but prosecutors decided not to after reviewing evidence favorable to West.

West and Seppi were arrested last year after a former College of Charleston student said two men assaulted her during a party hosted by Alpha Epsilon Pi’s Chi Omicron chapter. The victim is pursuing a lawsuit against West and Seppi.
